CITRA - A 16-year-old high school student who had consensual sex with her 14-year-old boyfriend in the girl's restroom at their school was arrested and charged with one count of lewd or lascivious battery, according to a Sheriff's Office report.

Thursday at about 11 a.m., a deputy was notified about the incident, which reportedly occurred at North Marion High School on Wednesday.

In a statement written by the 14-year-old, he told a deputy that he met his girlfriend during the sixth period and went to a building where they kissed. The boy said they then went upstairs to the girl's bathroom, where they had sex.

He said both left the bathroom and went to another section of the school, where they were spotted by a teacher who told them to go to class.

The 16-year-old gave a similar story. Both statements were taken by the school's dean.

A deputy interviewed both juveniles, who admitted to having sex in the bathroom.

The girl was taken to the Marion County Sheriff's Office for an interview, where she spoke to a detective before being arrested and transported to the Juvenile Assessment Center.

Under state statues, it states that an offender younger than 18 who commits lewd or lascivious molestation against a victim 12 or older, but less than 16, commits a felony of the third degree.

School District spokesman Kevin Christian said the girl has been suspended for 10 days and will be recommended for expulsion. The 14-year-old also will be suspended for 10 days and then be placed in an alternative school.
